Producers under E-waste 2016 Rules

A producer encompasses any individual engaged in the sale of E-waste, regardless of the sales method employed, including dealers, retailers, e-retailers, and more.

Produces and markets electrical and electronic equipment, along with their components, consumables, parts, or spares, bearing its brand.

Sells under its proprietary brand, assembled electrical and electronic equipment, along with their components, consumables, parts, or spares, sourced from other manufacturers or suppliers.

Engages in the sale of imported electrical and electronic equipment, including their components, consumables, parts, or spares.

About E-Waste EPR

Extended Producer Responsibility (EPR) is an obligation that rests upon all producers of Electrical and Electronic Equipment (EEE) to direct e-waste to authorized dismantlers or recyclers for responsible disposal. This responsibility may encompass the establishment of a take-back system, the creation of collection centres, or a combination of both. Additionally, producers are required to have established agreements with authorized dismantlers or recyclers, either independently or collectively through a Producer Responsibility Organization (PRO).

According to the E-Waste (Management) Rules of 2016, EPR authorization has become a compulsory requirement for all, including producers, importers, and e-retailers/online sellers, including those on platforms like eBay, dealing with Electrical and Electronic Equipment (EEE).

Role & Responsibilities of PRO

A Producer Responsibility Organization (PRO) is a certified professional entity, funded either collectively or individually by producers. PROs are entrusted with the task of collecting and directing e-waste, generated from the end-of-life stage of producers' products, towards environmentally sustainable management practices. PROs play a pivotal role in helping producers meet collection targets, establish collection centres/points, implement take-back programs, and conduct awareness campaigns, among other responsibilities. An agreement between the PRO and the producer(s) is essential, outlining the specific roles and responsibilities of the PRO in managing Extended Producer Responsibility (EPR) initiatives.

Achieving collection targets includes setting up collection mechanisms, like door-to-door collection and storage facilities per Central Pollution Control Board guidelines, along with implementing buy-back/take-back programs.

Carrying out awareness programs for consumers, bulk consumers, and producers to promote waste collection and channelization.

Managing logistics, guaranteeing traceability of collected e-waste, handling processed waste and end-of-life electronics, and ensuring environmentally responsible dismantling and recycling.

Assisting producers in submitting quarterly/annual returns by the regulations.

Furnish an Extended Producer Responsibility (EPR) plan as mandated by law.
